hmmm. unless yankee law is VERY different, i think you’ll find that this is just the policy adopted by the insurance companies as the long-term average result of the law, as a mechanism for reducing cost/admin. you can sometimes get them to step away from this position.
in the first instance, protest very strongly to your own company, accompanying letter with diagrams and if possible photos of the scene. also, if you can get the cops to prosecute the guy for dangerous driving (or similar) you should be automatically removed from any fault-consideration
